Govt. Appoints Officers for Compounding Offences Under OSHWC Code

The Ministry of Labour and Employment has issued a notification appointing the Director General and Deputy Director General of the Directorate General Factory Advice Service and Labour Institutes (DGFASLI), Mumbai, as officers under Section 114(1) of the Occupational Safety, Health and Working Conditions Code, 2020.

The appointment relates to composition of offences concerning dock work in all major ports.

1. Appointment Under Section 114(1) of the OSHWC Code

Section 114(1) of the Occupational Safety, Health and Working Conditions Code, 2020 empowers the appropriate Government to appoint officers authorised to compound specified offences under the Code.

In exercise of these powers, the Ministry has designated the Director General and Deputy Director General, DGFASLI, Mumbai, for matters relating to dock work.

2. Jurisdiction Across All Major Ports

The notification specifies that the appointed officers shall exercise powers relating to composition of offences concerning dock work in all major ports across India.

Accordingly, the designated authorities will have jurisdiction over establishments and operations connected with dock work falling within the scope of the Code.

3. Role in Composition of Offences

The appointed officers will be responsible for handling matters relating to compounding of offences under the Occupational Safety, Health and Working Conditions Code, 2020 in relation to dock work activities.

The composition mechanism enables settlement of specified offences through payment of prescribed compounding amounts, thereby facilitating administrative resolution of eligible non-compliances.

4. Role of DGFASLI

The Directorate General Factory Advice Service and Labour Institutes (DGFASLI) is a technical organisation under the Ministry of Labour and Employment dealing with industrial safety, occupational health and welfare matters, including safety standards relating to factories and dock operations.

The appointment aligns the composition framework with the specialised expertise of DGFASLI in dock safety and labour welfare matters.

5. Objective of the Notification

The notification aims to operationalise the composition framework for offences relating to dock work under the Occupational Safety, Health and Working Conditions Code, 2020.

The measure is intended to strengthen enforcement administration, facilitate resolution of specified violations and ensure effective compliance oversight in major port operations across India.
