1. Introduction
The Ministry of Finance has taken a significant step to strengthen the legal representation of the Directorate of Enforcement (ED) by appointing a panel of advocates as Special Public Prosecutors (SPPs). This move is aimed at ensuring effective prosecution in cases under the Prevention of Money-laundering Act, 2002 (PMLA).
2. Appointment Of Special Public Prosecutors
A total of 53 advocates have been appointed as SPPs to represent the ED before Special Courts constituted under the PMLA. These counsels will play a crucial role in handling complex money laundering cases and advancing the government’s efforts to curb financial crimes and illicit fund flows.
3. Geographical Coverage
The appointments span across a wide range of states and union territories, ensuring nationwide legal coverage for money-laundering cases. The designated regions include Assam, Goa, Maharashtra, Tamil Nadu, NCT of Delhi, West Bengal, and several others, reflecting the ED’s need for strong representation across diverse jurisdictions.
4. Tenure Of Appointment
Each appointed advocate will serve as a Special Public Prosecutor for the tenure specified in the official notification. The fixed tenure ensures clarity and continuity in case handling, while also allowing for periodic review and rotation of legal professionals based on performance and requirements.
