ASIC RG 234 Advertising Guidance

The Australian Securities and Investments Commission (ASIC) has updated Regulatory Guide 234 (RG 234) to help industry participants ensure that advertisements for financial products and services are clear, accurate and not misleading.

1. Key Changes Introduced

The revised guidance:

  • Incorporates learnings from ASIC’s recent regulatory and enforcement actions;
  • Consolidates guidance previously contained in Regulatory Guide 53 (RG 53) on the use of past performance in promotional materials; and
  • Simplifies the existing framework to improve clarity and accessibility.

2. RG 53 Withdrawn

As a result of the consolidation, RG 53 has been withdrawn, and all relevant guidance on advertising financial products and services is now contained within RG 234.

3. Guidance for Industry Participants

The updated guide provides direction to:

  • Promoters of financial products and services;
  • Credit providers; and
  • Advertising publishers

on avoiding false, misleading or deceptive representations in advertisements.

4. Consultation Process

The revisions follow a public consultation conducted between November 2025 and January 2026, during which stakeholders broadly supported the proposed changes.
