Tax audit plays a vital role in ensuring compliance with the provisions of the Income Tax Act, 1961, and reporting obligations. One of the essential components of the tax audit report is Form 3CD, which consists of various clauses to guide the auditor in their reporting duties. Among these, Clauses 30A of Form 3CD under the Income Tax Act, 1961 outlines the reporting of primary adjustments to transfer pricing under Section 92CE, including details on amounts and repatriation status, applicable to assessees involved in international transactions, Clause 30B assesses the allowability of interest on debt from a non-resident Associate enterprise (AE) under Section 94B, with restrictions if interest exceeds Rs. 1 crore or if the debt is guaranteed by an Associate enterprise (AE) and Clause 30C mandates disclosure of any Impermissible Avoidance Arrangements (IAA) under Chapter X-A, including the nature and tax benefits gained. These clauses collectively cover transfer pricing, interest deductibility, and tax avoidance arrangements.
