NCLAT directs Google to pay 10% of Rs. 1,337.76 crore penalty imposed by CCI

Earlier, the Competition Commission of India (CCI) in October, 2022 penalized Google for Rs. 1,337.76 crores for engaging in anti-competitive behaviour with regard to Android mobile devices. The internet giant had also been ordered to stop engaging in a number of unfair business practices by the CCI in the judgement.

As punishment for allegedly “abusing” its dominating position in a number of Android markets, the CCI had also imposed non-monetary restrictions on Google. It also directed the tech giant to “modify its conduct”. Subsequently, Google submitted a petition to request for an interim stay of the penalty.

Now, on Wednesday, the NCLAT ordered Google to pay 10% of Rs 1,337.76-crore as a fine that the internet giant was hit with by the fair-trade regulator CCI. Also, a two-member bench refused to give a stay of execution of the CCI penalty and stated that it would issue an order only after hearing from all parties.

The NCLAT’s decision was followed by a petition from Google that contested the CCI’s ruling that the tech giant had abused its dominant position in a number of markets within the Android mobile ecosystem. To which, Google contended that the decision was unfair to Indian consumers and would drive up the cost of such gadgets in that country.
