IBBI Introduces ‘Information of Dispute’ Framework for Information Utilities

The Insolvency and Bankruptcy Board of India (IBBI) has amended the Information Utilities Regulations, 2017 to strengthen the framework relating to recording, authentication and dissemination of information concerning defaults under the Insolvency and Bankruptcy Code, 2016 (IBC).
The amendments introduce the concept of “Information of Dispute”, prescribe procedures for recording authentication status of default information and streamline the regulatory framework governing records maintained by Information Utilities (IUs).
1. Concept of “Information of Dispute” Introduced
A key amendment is the introduction of the concept of “Information of Dispute” within the Information Utilities framework.
The new mechanism is intended to enable recording and reporting of disputes relating to information of default submitted to Information Utilities, thereby providing a more comprehensive picture of the status of debt and default-related information.
2. Recording Status of Authentication of Information of Default
The amended regulations prescribe the manner in which Information Utilities shall record the authentication status of information of default.
The framework seeks to improve transparency by clearly reflecting whether information has been:
- Authenticated;
- Partially authenticated;
- Disputed; or
- Otherwise pending confirmation.
This will assist stakeholders in assessing the evidentiary status of information maintained by Information Utilities.
3. Issuance of Record of Default or Information of Dispute
The amendments provide for issuance by Information Utilities of:
- Record of Default; or
- Information of Dispute
as applicable based on the status of the information available with the Information Utility.
This enables stakeholders and adjudicating authorities to obtain more accurate and context-specific records.
4. Authentication of Undisputed Default Amounts Permitted
The amended framework permits authentication of undisputed default amounts in specified situations even where disputes may exist in relation to other aspects of the debt or claim.
This provision is intended to facilitate more precise recording of default information and avoid unnecessary delays in authentication of uncontested amounts.
5. Forms to Be Notified by the Board
The amendments also replace prescribed forms contained in the Regulations with a framework under which relevant formats shall be:
- Notified separately by the IBBI; and
- Updated from time to time through circulars or directions
This change provides greater flexibility in updating procedural requirements without requiring formal amendments to the Regulations.
6. Objective of the Amendments
The amendments aim to improve the reliability, transparency and evidentiary value of information maintained by Information Utilities.
By introducing the concept of Information of Dispute, clarifying authentication status, permitting issuance of dispute-related records and enabling authentication of undisputed default amounts, IBBI seeks to strengthen the information infrastructure supporting insolvency proceedings under the Insolvency and Bankruptcy Code, 2016.
