Govt. Notifies Special Courts for Companies Act Cases in Punjab, Haryana and Chandigarh

The Central Government has designated specific courts as Special Courts for the purpose of ensuring speedy trials of offences under the Companies Act, 2013.
1. Legal Basis for the Designation
This designation is made in exercise of the powers granted under Section 435(1) of the Companies Act, 2013, which empowers the Central Government to establish or designate Special Courts for the trial of offences punishable under the Act.
2. Jurisdiction of the Designated Special Courts
The newly designated Special Courts will exercise jurisdiction over:
- The State of Punjab
- The State of Haryana
- The Union Territory of Chandigarh
These courts will exclusively handle cases involving offences committed under the Companies Act, 2013, arising within these jurisdictions.
3. Objective – Speedy and Focused Adjudication
The primary purpose of this notification is to:
- Expedite adjudication of corporate offences
- Ensure judicial efficiency in handling cases related to company law violations
- Reduce backlog and promote timely enforcement of corporate governance norms
4. Implications for Stakeholders
- Companies, directors, officers, and professionals in these regions must now approach the designated Special Courts for matters involving prosecution under the Companies Act.
- Litigants and regulators can expect faster resolution of company law cases through these dedicated judicial forums.
