FCRA Amendment Rules

1. Regulatory Background

The Ministry of Home Affairs (MHA) published the Foreign Contribution (Regulation) Amendment Rules, 2025 in the Gazette on 26 May 2025. The notification amends several statutory forms under the 2011 Rules to tighten documentation and disclosure standards for NGOs and other associations that receive foreign funds.

2. Effective Date

All amendments take effect immediately—i.e., from 26 May 2025, the date of publication in the Official Gazette.

3. Compliance Impact & Action Points for NGOs

  1. Update internal checklists – Incorporate the new document sets into your grant-proposal and statutory-filing SOPs.
  2. Coordinate with donors early – Secure commitment letters in the format MHA expects before submitting FC-3B.
  3. Strengthen board governance – Every change now requires a formally minuted resolution—plan board meetings in advance.
  4. Align AML/CFT controls – Draft the FATF-based undertaking and ensure finance teams can track admin-expense caps.
  5. File with the latest utilities – Download the revised e-forms once the FCRA portal updates; legacy versions may be rejected.
