The Ministry of Corporate Affairs (MCA) has extended the tenure of Shri Barun Mitra and Shri Naresh Salecha as Technical Members of the National Company Law Appellate Tribunal (NCLAT) under Section 410 of the Companies Act, 2013.
1. Extension of Tenure of Technical Members
The tenure of the following Technical Members has been extended:
- Shri Barun Mitra
- Shri Naresh Salecha
The extension has been granted to ensure continuity in functioning and adjudicatory processes of the National Company Law Appellate Tribunal.
2. Period of Extension
The extended tenure shall remain effective from 17 May 2026 and continue till:
- 08 September 2026; or
- Attainment of the age of sixty-seven years under the Tribunal Reforms Act, 2021,
whichever is earlier.
3. Appointment Under Section 410 of the Companies Act, 2013
The extension has been made under Section 410 of the Companies Act, 2013, which provides for the constitution of the National Company Law Appellate Tribunal and appointment of Judicial and Technical Members for adjudication of matters arising under company law, insolvency law and related legislations.
4. Role of Technical Members in NCLAT
Technical Members of NCLAT assist in adjudication of appeals involving:
- Company law matters
- Insolvency and bankruptcy proceedings
- Competition law matters
- Corporate restructuring and regulatory disputes
Their technical expertise supports effective adjudication of complex legal and commercial issues before the appellate tribunal.
5. Objective of the Extension
The extension is intended to ensure continuity in the functioning of the NCLAT and maintain institutional efficiency in disposal of appeals and adjudication of corporate and insolvency-related matters pending before the Tribunal.
