Govt. Appoints Appellate Authorities Under OSHWC Code 2020

The Ministry of Labour and Employment has issued a notification appointing Additional Chief Labour Commissioners and Deputy Chief Labour Commissioners (Central) as appellate authorities under Section 111(3) of the Occupational Safety, Health and Working Conditions Code, 2020.

The appointments relate to hearing appeals under the Code in establishments where the Central Government is the appropriate Government.

1. Appointment of Appellate Authorities

The notified Additional Chief Labour Commissioners and Deputy Chief Labour Commissioners (Central) have been authorised to function as appellate authorities for matters arising under the Occupational Safety, Health and Working Conditions Code, 2020.

These officers will exercise appellate powers in accordance with the provisions of Section 111(3) of the Code.

2. Jurisdiction-Wise Allocation of Powers

The notification specifies territorial and jurisdiction-wise allocation of appellate powers among the designated authorities.

Different officers have been assigned responsibility for hearing appeals within their respective States, regions and Union Territories to ensure effective and decentralised administration of the appellate framework.

3. Scope of Appellate Functions

The appointed authorities will hear and decide appeals arising under the Occupational Safety, Health and Working Conditions Code, 2020 relating to matters governed by the Code within their jurisdiction.

The appellate mechanism is intended to provide an institutional forum for review of orders and decisions passed under the occupational safety and labour compliance framework.

4. Applicability to Central Government Establishments

The notification applies to establishments where the Central Government is the appropriate Government under the Occupational Safety, Health and Working Conditions Code, 2020.

The designated appellate authorities shall exercise powers over such establishments within their notified territorial jurisdiction.

5. Objective of the Notification

The appointment seeks to operationalise the appellate mechanism under the Occupational Safety, Health and Working Conditions Code, 2020 and strengthen dispute resolution and regulatory oversight under the labour code regime.

By designating jurisdiction-specific appellate authorities, the Ministry aims to ensure timely disposal of appeals, administrative efficiency and effective enforcement of occupational safety and working condition standards.
