France has issued guidance on the electronic reporting (e-reporting) requirements applicable to foreign companies without a permanent establishment in France for Value Added Tax (VAT) purposes. The guidance outlines the transactions subject to e-reporting, the implementation timeline and the applicable compliance obligations for such companies.
The key aspects of the guidance are discussed below
(a) Applicability of E-Invoicing
The electronic invoicing (e-invoicing) applies only to purchases and sales of goods and/or supplies of services carried out in France between VAT-taxable persons established in France. Accordingly, foreign companies without a permanent establishment in France are outside the scope of e-invoicing. However, where such companies are liable for French VAT on transactions taking place in France, they must comply with the e-reporting requirements.
Unlike e-invoicing, e-reporting does not involve issuing or receiving invoices. Instead, it requires businesses to electronically report certain transaction information (including the transaction value and VAT charged) to the French tax authority for commercial transactions that are not covered by the e-invoicing.
(b) Implementation timeline
The e-reporting requirements will be implemented as follows:
- 01-09-2026: Large enterprises and intermediate-sized enterprises (ISEs) supplying goods or services
- 01-09-2027: Micro-enterprises, very small enterprises (VSEs) and small and medium-sized enterprises (SMEs) supplying goods or services.
- 01-09-2027: Enterprises acting as VAT-liable buyers in reverse charge transactions and intra-Community acquisitions, irrespective of their size.
- Optional early compliance: Micro-enterprises, VSEs and SMEs may opt to comply with the e-reporting requirements from 01-09-2026.
