Supply of restaurant services through e-commerce operators (‘ECO’) would now be covered within the scope of Section 9(5) of the CGST Act, 2017 w.e.f January 1, 2022. Therefore, liability to pay GST on such supplies would shift from restaurants to ECOs. This paradigm shift of GST liability would have impact on the food aggregators and almost all the restaurants in India. In this background, suppliers operating in both these industries may have various questions. This document would provide guidance to restaurants and ECOs for implementing the given changes.
