NPA management is an important function in every financial institution, as it has an important bearing on all aspects of the institution’s financial health.

NPA management and recovery efforts assume much significance in the backdrop of current stress in balance sheet of corporates leading to stress banks’ balance sheet. Reserve Bank of India (RBI) has come out proactively with series of measures for restructuring/ resolution of stressed assets.

Subsequent to the ordinance amending the Banking  Regulation Act, RBI vide their press release dated June 12, 2017 has also identified 12 accounts for immediate reference under Insolvency and Bankruptcy Code (IBC), 2016.

Further as regards the other non-performing accounts which do not qualify under the above criteria, the Internal Advisory Committee recommended that banks should finalise a resolution plan within six months. In cases where a viable resolution plan within six months, banks should be required to file for insolvency proceedings under the IBC.

In the above backdrop, ‘Book on Practical Guide to NPA Resolution’ authored by Shri R.C. Kohli can be a great resource for bank officials involved in the resolution process including IBC, 2016.

The book provides an in-depth analysis of various types of mechanisms for resolution of NPAs / Stressed Assets including the process for proceedings under the SARFAESI Act and DRT Act, procedure for insolvency resolution / liquidation process under Insolvency and Bankruptcy Code, 2016, procedure for NPA Resolution under Insolvency and Bankruptcy Code, 2016 System and procedure for taking possession of the movable / immovable assets and sale thereof through various modes including e-auction.

The book also includes case studies for practical orientation and important case laws of various courts including Supreme Court. Ready to use formats for taking action under the SARFAESI Act and other modes of recovery etc. are made available in the book.

In view of the foregoing the book will be very handy for practicing Bankers as well as Legal Professionals.
